Photography & Media Release Waiver
Permission to Photograph and Record. I hereby grant permission to The Salty Siren LLC, its employees, contractors, photographers, videographers, and authorized representatives to photograph, video record, and/or audio record me and/or my minor child during participation in a Salty Siren event or activity.
I understand these photographs, videos, or recordings may be used for lawful business purposes including, but not limited to:
- Social Media (Facebook, Instagram, TikTok, YouTube)
- The Salty Siren LLC website
- Advertising and promotional materials
- Printed brochures and marketing materials
- News articles and publications
- Educational presentations
- Future promotional campaigns
No Compensation. I understand that I will receive no financial compensation for the use of these photographs, videos, or recordings.
Ownership. I acknowledge that all photographs, videos, and recordings taken by or on behalf of The Salty Siren LLC remain the exclusive property of The Salty Siren LLC.
Release of Claims. I release and discharge The Salty Siren LLC, its owner, employees, contractors, volunteers, and representatives from any claims related to the use of my or my child's image, likeness, voice, or appearance in accordance with this release.
My media preference (whether photos/videos of me or my child may be used for promotional purposes) is recorded separately in the booking request above. Please note that participants may still appear incidentally in background photographs or videos taken during public events.
Booking, Payment, Cancellation, Refund & Weather Policy
1. Reservation of Services
A booking is confirmed only after The Salty Siren LLC receives the required signed Booking Agreement and deposit or full payment. Upon confirmation, The Salty Siren LLC immediately reserves performers, equipment, travel time, and scheduling exclusively for the Client and declines other potential bookings for the reserved date and time. Accordingly, the Client understands that The Salty Siren LLC incurs costs immediately upon accepting a reservation.
2. Payments
Unless otherwise stated in writing:
- A non-refundable deposit is required to reserve the event.
- The remaining balance is due no later than 24 hours prior to the event.
- Bookings made within fourteen (14) days of the event require payment in full at the time of booking.
- Failure to make timely payment may result in cancellation of the reservation without refund of monies previously paid.
3. Client Cancellation Policy
Because The Salty Siren LLC reserves performers and turns away other business once an event is booked:
ALL PAYMENTS ARE NON-REFUNDABLE. The Client may cancel the event at any time; however:
- No refunds will be issued.
- No credits are guaranteed.
- No future event credit is guaranteed.
- No reduction of the contracted balance will be provided.
This policy applies regardless of the reason for cancellation, including but not limited to: illness, scheduling conflicts, weather concerns when The Salty Siren LLC determines conditions are safe, family emergencies, change of venue, reduced attendance, guest cancellations, travel issues, personal reasons, or any circumstance outside the Company's control.
4. Rescheduling
Requests to reschedule are considered solely as a courtesy. The Salty Siren LLC is under no obligation to reschedule any event. If a reschedule is approved: it must occur within twelve (12) months of the original event date; it is subject to performer and company availability; and all payments previously made will be applied to the rescheduled event. If no mutually agreeable date is available, all payments remain non-refundable.
5. Weather Policy
The safety of our performers and guests is our highest priority. Because many events occur outdoors or near pools, rivers, creeks, lakes, and other natural bodies of water, weather conditions may require modification or cancellation of services. The Salty Siren LLC has the sole authority to determine whether weather conditions are safe.
Unsafe conditions include, but are not limited to: lightning, thunder, heavy rain, flash flooding, flood warnings, unsafe creek or river conditions, strong currents, high winds, tornado watches or warnings, hail, ice, excessive heat, poor water quality, dangerous wildlife, unsafe roads, or any condition that presents an unreasonable safety risk. The Company's determination shall be final.
6. Client Weather Cancellation
If the Client elects to cancel the event due to weather after The Salty Siren LLC has determined conditions are safe to perform, the cancellation shall be treated as a Client cancellation. Accordingly: no refund shall be issued; no credit shall be issued; rescheduling shall remain solely at the discretion of The Salty Siren LLC.
7. Cancellation by The Salty Siren LLC
If The Salty Siren LLC determines that weather, road conditions, water conditions, equipment failure, performer illness, injury, emergency, or another circumstance makes performance unsafe or impossible, The Salty Siren LLC may cancel the event. In such event, the Client shall receive one of the following remedies, as determined by The Salty Siren LLC: rescheduling of the event within six (6) months, subject to availability; or a full refund of all monies paid for services not rendered if The Salty Siren LLC is unable to provide a suitable replacement performer or reschedule the event within six (6) months.
8. Right to Terminate Services
The Salty Siren LLC reserves the right to immediately suspend or terminate services without refund if: guests become abusive or threatening; the venue becomes unsafe; illegal activity occurs; alcohol or drugs impair guest safety; performers are harassed or assaulted; children are left unsupervised; animals create an unsafe condition; guests refuse to follow safety instructions; or any condition presents an unreasonable safety risk. Termination under this section shall not constitute a cancellation by The Salty Siren LLC and shall not entitle the Client to any refund.
9. Force Majeure
The Salty Siren LLC shall not be liable for delays or inability to perform due to events beyond its reasonable control, including but not limited to: natural disasters; flooding; severe weather; government orders; epidemics or pandemics; civil unrest; road closures; utility failures; or other unforeseen emergencies. In such circumstances, The Salty Siren LLC may, at its discretion, reschedule the event or issue a refund if performance cannot reasonably occur within six (6) months.
10. Acceptance
By signing this Agreement electronically or in writing, the Client acknowledges that they have read, understand, and voluntarily agree to this Booking, Cancellation, Refund, and Weather Policy.
Performer Interaction Rules
Guests agree: no pulling tail; no climbing on mermaid; no grabbing hair; no touching face; no feeding performer; no throwing objects; no entering performer changing area.
Child Behavior Expectations
Parents remain responsible. Children may not: hit, kick, push, pull tails, throw sand, rocks, or other items, or enter deep water without a parent.
Animal Policy
If pets are present, the Client certifies pets will be secured, vaccinated, controlled, and non-aggressive.
